Terms of Use

These Terms govern your use of the AFTERGLOW game and website (“AFTERGLOW”, “we”, “us”), operated by BOFF GmbH (boff.ch), Switzerland. By using AFTERGLOW you agree to these Terms. If you do not agree, please do not use the app.

The app

AFTERGLOW is a free collection of arcade games with a global leaderboard. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own entertainment. For the iOS version, Apple’s Standard End User License Agreement (EULA) also applies and, where it conflicts with these Terms for the iOS app, takes precedence.

Acceptable use

When using AFTERGLOW, you agree that you will not:

User-submitted content & moderation

The display name and optional city you submit are user-generated content shown publicly to other players. You are responsible for what you submit. We operate a zero-tolerance policy for objectionable content and may, at our sole discretion and without notice:

Report objectionable content to info@boff.ch. We aim to review reports and remove violating content within 24 hours.

Leaderboard

Scores are verified server-side to keep the board fair. We may reset, recalculate or clean the leaderboard, and remove entries that appear forged or that violate these Terms.

No warranty

AFTERGLOW is provided “as is” and “as available”, without warranties of any kind. We do not guarantee the service will be uninterrupted, error-free, or that scores or data will always be preserved.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of AFTERGLOW. Nothing in these Terms limits liability that cannot be limited under applicable law.

Changes

We may update these Terms. Continued use after changes means you accept the updated Terms. The current version is indicated by the “last updated” date above.

Governing law

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules, and the courts of Switzerland have jurisdiction, unless mandatory consumer law provides otherwise.
